This application, for grant of regular bail, arises out of Bahairavsthan Madhubani Police Station Case No. 60/2022, registered for the offence punishable under Sections 25(1-b)a, 26, 35 of Arms Act and Sections 30(a), 36 & 41(1) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

It is alleged that 747 litres of foreign liquor has been recovered from the Bagicha of the petitioner. The petitioner is in custody since 03.11.2022 and he has five more criminal antecedents.

Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in the present case.

Considering the fact and circumstances of the case, let

Patna High Court CR. MISC. No.20738 of 2023(2) dt.22-05-2023 2/2 the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Jhanjharpur, Madhubani, in connection with Bahairavsthan Madhubani Police Station Case No. 60/2022. The petitioner shall mark his presence in Bahairavsthan Madhubani Police Station, Distt- Madhubani on 1st Sunday of every month, failing which, the bail bonds of the petitioner would be cancelled.
