JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kateya P.S. Case No. 14 of 2015 registered for the offences punishable under Sections 448, 341, 323, 325, 307, 504/34 of the Indian Penal Code.

Petitioners are said to be agnates of informant. There is case and counter case between the parties and petitioners no. 1 and 2 are said to be sustained injury also in the alleged occurrence. Annexure-4 to this petition reveals that informant sustained altogether four injuries out of which injury no. 1 was found simple in nature whereas opinion regarding the injury nos. 2, 3 and 4 was

Patna High Court Cr.Misc. No.21088 of 2015 (2) dt.03-07-2015 kept reserved. Furthermore, it would appear from Annexure-4 that injury nos. 2, 3 and 4 were found on palm, leg etc. and not on the vital part of body of the informant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Kateya P.S. Case No. 14 of 2015 subject to condition as laid down under Section 438(2) of the Cr.P.C.
