The petitioner, in custody since 15.03.2018, seeks bail in connection with Gopalganj Town P.S.Case No. 127 of 2018 registered under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act and Section 25(1-b)a/26 of the Arms Act.
Allegation in brief is that one country made loaded pistol and 1.550 Kg Ganja were recovered from the possession of the petitioner.
It is submitted that petitioner has been falsely implicated in this case as is evident from the impugned order that he was apprehended, as per FIR, on 13.03.2018 and was produced before the Magistrate after more than 36 hours and in this
Patna High Court Cr.Misc. No.30797 of 2018(2) dt.17-05-2018 2/2 regard, explanation was also asked by the learned Sessions Judge but no such explanation was submitted.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Nurain Miyan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ADJ 1st, Gopalganj in connection with Gopalganj Town P.S. Case No. 127 of 2018 (T.R.No. 10 of 2018).
