The petitioner retired after attaining the age of superannuation on 30.11.2019.
The grievance of the petitioner in the present writ application is non-payment of salary from September, 2019 to November, 2019 and also non-payment of post-retiral dues.
Patna High Court CWJC No.4982 of 2020(2) dt.25-06-2020 2/2 Considering the fact that the petitioner retired in November, 2019 and there is statement on behalf of the petitioner that no departmental proceeding was pending against the petitioner, the writ application is disposed of with a direction to the respondents to take final decision with regard to payment of salary from September, 2019 to November, 2019 and also take final decision with regard to post-retiral dues of the petitioner, if not already paid, within a maximum period of four months from the date of receipt/production of a copy of this order and ensure payment thereof within the aforesaid period, failing which, the petitioner shall be entitled to payment of interest at the rate of 9% per annum from the date of filing of writ petition till the date of actual payment. .
