Petitioner apprehends arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.
Open aluminium wire, electric pole, covered aluminium wire, small pieces of old covered wire in a bundle etc. have been recovered from pick-up van. It is alleged after seeing the Police, all the accused persons fled away from the spot.
Learned counsel appearing for the petitioner submits that no incriminating article has been recovered from possession of the petitioner and he has been made accused only on the basis
Patna High Court CR. MISC. No.16624 of 2023(2) dt.19-05-2023 2/2 of suspicion. Petitioner has got clean antecedent. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Dumra P. S. Case No. 145 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
