====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Rupaspur P. S. Case No. 916/2023 in a case registered for the offences punishable under Sections 341, 448, 323, 302, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, this petitioner along with other F.I.R. named accused persons assaulted informant and his family members by means of deadly weapons as a result of which father of the informant succumbed to the injuries.
4. Learned counsel for the petitioner submits that petitioner is only alleged to have assisted co-accused Sanjeev Kumar Verma and Praveen Kumar Singh in the alleged offence. There is no specific allegation of overt act against this

He further submits that co-accused Sanjeev Kumar Verma, against whom there is specific allegation of firing, has already been granted regular bail vide order dated 29.01.2025 passed in Cr. Misc. No. 77866 of 2024. Petitioner is in custody since 26.11.2024.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Danapur, Patna in connection with Rupaspur P. S. Case No. 916 of 2023.
