This is a case registered under Sections 457 and 380 of the Indian Penal Code.

The FIR discloses that while the informant was waking up he found Rs. 6500/- and two mobiles sets which have been stolen by unknown persons.

Counsel for the petitioner submits that the petitioner has been implicated in this case because he is friend of one Rohit Kumar from whose possession M Touch mobile set has been recovered. He further submits that he is a student and that from his possession no such article has been recovered. He also submits that the petitioner has clean antecedent and he is in custody since

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in Turkaulia P.S. Case No. 245 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.
