JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2018 Petitioners apprehend their arrest in connection with Sasaram (Mufassil) P.S.Case No. 991 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 384, 504 and 506 of the Indian Penal Code.
Allegation against the petitioners and other accused persons is that have called the informant he was asked to pay Rs.2 lakh as extortion from his father and when he refused they have assaulted him.
Submission of learned counsel for the petitioners is that there is delay of 10 days in lodging FIR and there is no injury report available on record and moreover the case has been lodged on 17.7.2017 and on the same day charge sheet has been submitted
Patna High Court Cr.Misc. No.31816 of 2018 (3) dt.29-06-2018 2/2 against the petitioners and there is no specific allegation against the petitioners.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, surrender within a period of six weeks from the receipt of this order and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Muffasil) P.S.Case No. 991of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
