The petitioner seeks bail in a case registered for the offence under Sections 341, 384, 353, 307, 379, 411, 34 of the Indian Penal Code.

As per the prosecution case, one truck loaded with 800 cft. illegal stones (chips) was seized and thereafter, it is alleged that this petitioner alongwith other co-accused assaulted the police force and tried to get the truck in question released. It is submitted that there is general and omnibus allegation and petitioner has been falsely implicated in this case at the instance of his enemies. Some of the co-accused persons namely Vikash Kumar and Birendra Kumar have already been granted bail by this Court, vide order dated 10.05.2022 passed

Patna High Court CR. MISC. No.15807 of 2022(2) dt.17-05-2022 2/2 in Cr.Misc. No. 13229 of 2022 and order dated 12.05.2022 passed in Cr.Misc. 14646 of 2022 respectively. Petitioner is in custody since 07.12.2021 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Muffasil P.S.
