The petitioner is languishing in custody in a case registered for the offences punishable under Sections 364(A), 395, 397 of the Indian Penal Code. It is a case of kidnapping of the informant by all the F.I.R named accused persons including the petitioner. The petitioner was apprehended by the police during checking while the petitioner and another coaccused were taking the informant to a Maruti Wagon-R car.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.15857 of 2023(3) dt.17-07-2023 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was apprehended by the police from his house but place of arrest of the petitioner was shown from Wagon-R car through which the informant was taking away. Nothing has been recovered from the conscious possession of the petitioner. There is general and omnibus allegation against the petitioner. The petitioner has been remanded in the present case on 30.08.2022 and since then he is in jail. Moreover, other similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 07.07.2023 passed in Cr. Misc. No. 34507 of 2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.15857 of 2023(3) dt.17-07-2023 3/3 (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 111 of 2022.
