Petitioner in the present case is seeking setting aside of the impugned order dated 17.02.2020 passed by the learned 1st Additional Sessions Judge-cum-Special Judge (Child), Araria in connection with Forbesganj P.S. Case No.189/2021 dated 12.03.2021 under Section 392 of the Indian Penal Code whereby and whereunder the learned court below has rejected the criminal appeal filed on behalf of the petitioner for grant of regular bail.
Learned counsel for the petitioner submits that the petitioner has been declared juvenile aged about 16 years 8 months and 16 days on the alleged date of occurrence. The petitioner is in observation home since 10.06.2021.

No.181 of 2022(4) dt.18-08-2022 2/2 Having regard to the report as contained in letter no.194 dated 01.06.2022 received from the learned 1st Additional District and Sessions Judge-cum-Special Judge, Araria showing that the trial has already begun and two out of five material witnesses have already been examined and that the trial is likely to be concluded within nine months, considering that the petitioner has got at least five criminal antecedents and he seems to be indulging in commission of offence one after another, this Court is not inclined to release the petitioner on bail at this stage. The nine months period within which the trial is expected to be concluded would come to an end by 1st of March, 2023.
The learned trial court is expected to conclude the trial by the said date, failing which it will be open for the petitioner to move this Court afresh.
