Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in Ekchari P.S. Case No. 33 of 2019, registered for the offences punishable under Sections 366, 366(A) of the Indian Penal Code. The informant alleged that co-accused Mithun Mandal enticed away the minor daughter of informant for the purpose of marriage after hatching up conspiracy with the petitioners and other accused persons.

Patna High Court CR. MISC. No.16218 of 2020(3) dt.05-11-2020 2/2 It is submitted that petitioners have been falsely implicated in this case. There is general and omnibus allegation. The victim girl in her statement under Section 164 Cr.P.C has clearly stated that she voluntarily left her house and went along with Mithun Mandal to Delhi. It is further stated that she has already performed marriage with Mithun Mandal in Delhi and are living as wife and husband.

In view of statement of victim girl under Section 164 Cr.P.C, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Ekchari P.S. Case No. 33 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
