Heard Mr Ajay Kumar Sinha, learned counsel for the petitioner and Mr. Suresh Prasad Singh, learned counsel for the State.

The petitioner, who is husband of the deceased seeks bail in connection with Maigra P.S. Case No. 31/19 instituted for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and that he is innocent. He further submits that he has remained in custody for about ten months by now and even the charges have not been framed. The other accused persons of this case have been granted bail.

However, regard being had to the nature of accusation against the petitioner, I am not inclined to grant bail to him for the present.

The prayer for bail is rejected.

However, taking into account the fact that the petitioner is in custody since 14.10.2019, this Court directs that charges in this case be framed without any delay and the trial be concluded within a period of nine months from the date of framing of the charge.

In case there is no substantial progress in the trial during this period, it would be open for the petitioner to approach this Court again.

The application stands disposed of with the aforesaid direction.
