2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 118(1), 109, 352, 351(2), 3(5) of B.N.S.S., 2023 and Section 27 of the Arms Act.
3. As per the prosecution case, on 18.09.2024 at 7.45 PM, while informant was sitting at his courtyard, these petitioners came on motorcycle and thereafter, petitioner no. 1 (Saroj Ray) fired a bullet on the knee of his left leg, due to which, he became unconscious and thereafter, both petitioners fled away.
4. It is submitted on behalf of petitioners that on
Patna High Court CR. MISC. No.16630 of 2025(4) dt.30-06-2025 2/2 account of land dispute between the parties, the alleged occurrence took place. As per F.I.R., there is no allegation of overt act against petitioner no. 2 (Naresh Ray).
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the fact that informant sustained bullet injury, caused by petitioner no.1 (Saroj Ray), the prayer for anticipatory bail of petitioner no. 1 is rejected.
7. So far as petitioner no. 2 (Naresh Ray) is concerned, there is no allegation of overt act against him, in the event of his arrest/surrender within a period of eight weeks from today, let the petitioner no. 2 namely Naresh Ray be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Biraul, District - Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 302 of 2024, subject to condition as laid down under Section 482(2) of the B.N.S.S., 2023.
