ANJANA MISHRA ORAL ORDER 29-06-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.01.2018 in connection with Lakhisarai P.S. Case No.38 of 2018 registered for the offence under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Diary in the present case was called for, which has since been received.

Learned counsel for the petitioner submits that save and except the allegation that this petitioner had pushed the informant, there is no further material in the case diary to implicate him and attribute any role against him. It is further submitted that the main allegation is against three co-accused,

Patna High Court Cr.Misc. No.32276 of 2018 (3) dt.29-06-2018 2/2 namely, Ranjeet Bind, Sanjeet Bind and Awadhesh Bind and not against this petitioner.

Learned counsel for the State after perusal of the case diary submits that, in fact, the main allegation is against the aforesaid three co-accused and not against the present petitioner.

Taking into consideration such facts and circumstances and that the petitioner has got no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S. Case No.38 of 2018.
