The petitioner apprehends his arrest in a case under Section 7 of the E.C. Act.
380 bags of rice weighing 190 quintals were recovered from the house of the petitioner. One truck bearing registration no. UP 619 8571 was also found in front of the house of the petitioner. It is submitted that the subsidized rice does not come under the Control Orders and there is no storage limit. The petitioner was not found selling the same in black-market. The truck was seized. The petitioner is not the owner of the truck. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on
Patna High Court Cr.Misc. No.17145 of 2016 (2) dt.13-05-2016 2/2 bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Brahmpur P.S. Case No. 40/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
