====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2020 The office has reported that present petition suffers from several defects.

However, learned counsel of the petitioner submits that all the defects are of simple nature and the defects shall be removed when the court starts physical functioning. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in jail custody since 10.12.2019 in connection with Patrakarnagar P.S. Case No. 1036 of 2019 registered under Sections 4, 5, 6 of Immoral Traffic (Prevention) Act.

Patna High Court CR. MISC. No.20772 of 2020(2) dt.08-09-2020 2/3 Petitioner and one Dharmshila Devi were caught from a house in which one girl along with co-accused Rajesh Kishore Gupta were also apprehended. The statement of aforesaid girl was recorded under Section 164 of the Cr.P.C. and the aforesaid girl stated that she was brought to Patna by co-accused Rajesh Kishore Gupta from Kolkata and she was pushed into flesh trade and the petitioner and co-accused Dharmshila Devi were running brothel.

Learned counsel of the petitioner submits that coaccused Dharmshila Devi has already been granted privilege of bail and the case of this petitioner stands on similar footing to the case of co-accused Dharmshila Devi.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Tanveer Kaur, learned Judicial Magistrate 1st Class, Patna in connection with Patrakarnagar P.S. Case No. 1036 of 2019.

However, it is made clear that petitioner shall remove the defects as pointed out by the office within two weeks from the date when the court starts physical functioning. The office
