The petitioners seek regular bail in connection with Kalyanpur P.S. Case No. 24 of 2021 dated 31.01.2021 instituted for the offences under Sections 30(a), 41(i) (ii) and 47 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the petitioners are in custody since 01.02.2021, charge-sheet has been submitted in this case and the petitioners are persons with clean antecedent.

Learned counsel for the petitioners submits that in the F.I.R. it is alleged that 123 litres of foreign liquor was recovered

Patna High Court CR. MISC. No.25676 of 2021(2) dt.17-11-2021 2/2 from a car.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 01.02.2021, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing of bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Samastipur in connection with Kalyanpur P.S. Case No. 24 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C.
