The petitioner is apprehending his arrest in connection with Ahiayapur P.S.Case No.916 of 2018 registered for offences punishable under Sections 302/34 of the Indian Penal Code. From the case diary it appears that the processes under Section 82 and 83 of the Cr.P.C. have already exhausted against this petitioner .

Submission of the learned counsel for the petitioner is that she is a lady and the materials are not sufficient to connect her with this case.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that this Court has not passed any order on merit but since processes under Sections 82 and 83 of the Cr.P.C. have already exhausted

Patna High Court CR. MISC. No.14912 of 2019(3) dt.02-05-2019 2/2 as such I am not inclined to grant privilege of anticipatory bail to the petitioner, however, if she surrenders surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record and if possible to be disposed of on the same day.

With the aforesaid direction, this application is disposed of.
