JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,341,337,307 and 353/34 of the Indian Penal Code.
The prosecution case is that on 25.4.2015 the informant being Circle Inspector along with other officers came to remove the encroachment in connection with Encroachment Case No. 8 of 2014. It is alleged that in course of encroachment, the petitioner threw bomb on the police personnel though Sunil Yadav received injury.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.17507 of 2016 (2) dt.26-04-2016 2/2 that the accusation is against mob and the injury report of Sunil Yadav reflects that the injury is simple caused by hard and blunt substance. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Madhubani, in connection with Babubarhi P.S. Case No. 55 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
