Mr. Ashok Kumar, APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 22-09-2017 The petitioner has been arrested in Special Case No.1242 of 2017 arising out of Khagaul P.S. Case No.63 of 2017 for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. He is in custody since 11.08.2017 On the basis of seizure of 441 litres of liquor recovered from the possession of a driver and cleaner of the truck in question and on the basis of the statement of co-accused Abhishek Kumar, the petitioner has been arrested. However, the co-accused Abhishek Kumar from whom the liquor was seized has been granted bail by this Court on 20th July, 2017 in Cr. Misc. No.33952 of 2017.

Keeping in view the aforesaid, this application is allowed. Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like
