The petitioners, who are brother-in-law and sister-in-law of the deceased, seek bail in connection with Bakhtiarpur P.S. Case No. 193 of 2017 dated 26.05.2017 instituted for the offences under Sections 304B, 363/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that petitioner No. 1, who is sister-in-law of the deceased was married sixteen years ago with petitioner No. 2 and both the petitioners do not have any concern with the affairs of the

Patna High Court Cr.Misc. No.47757 of 2017 (3) dt.07-12-2017 2/3 husband of the deceased. Merely because they happen to be related to the husband of the deceased, they have been made accused in this case.

Learned counsel for the informant, however, has pointed out from the F.I.R and the investigation papers that petitioners insinuated at the poor quality of motorcycle which was given as dowry and also commented on the deceased for having given birth to a female child.

Learned counsel for the petitioner, in response to the aforesaid, has stated that such allegation has only been levelled in order to rope in the petitioners in the present case. Regard being had to the nature of accusation against the petitioners and the special relationship in which they stand as against the deceased and her husband, this Court is inclined to grant bail to the petitioners. While saying so, this Court has also taken note of the fact that the husband of the deceased is in custody.

The petitioners are in custody since 31.05.2017. The petitioners, above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh
