The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 504, 506, 354A, 379 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes
Patna High Court Cr.Misc. No.21811 of 2015 (2) dt.21-05-2015 2/3 (Prevention of Atrocities) Act.
It is alleged that on 26.12.2014 at 4.00 pm all the accused persons including the petitioners came at the house of the informant and abused her by calling caste name. It is further alleged that on the order of petitioner Ashok Ram co-accused Bipin Ram took the informant down by catching her hair and assaulted by kick whereas co-accused Munna Ram took away silver chain from the neck of the informant, when sister-in-law (gotani) of the informant came to rescue she was also being abused by calling caste name by the accused persons. It is submitted by learned counsel for the petitioners that the accusation of assault is not specific against these petitioners. Admittedly, the occurrence took place at the door of the informant and statement has been made in paragraph 3 of both the petitions that the petitioners have no criminal antecedent. Moreover, the informant has admitted that the occurrence took place due to flow of drainage and a statement has been made in paragraph 8 of both the petitions that no injury was caused to the informant.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12
Patna High Court Cr.Misc. No.21811 of 2015 (2) dt.21-05-2015 3/3 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with SC/ST Biharsharif P.S. Case No.116 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
