JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 05-05-2015 There are many a gapping hole even in the sequence which counsel for the petitioner wants to establish with regard to authenticity of selection and appointment as a teacher (Lecturer) in the College in question. The reason for the University raising objection from time to time as well as not paying him the salary is related to those aspect of the matter.

2. Time has come when the University must take a final decision on the claim of the petitioner and his right to be recognized as a permanent validly appointed teacher of the College in question and the corresponding obligation of the University or the State to pay him salary on a regular basis.

3. It is not a co-incidence that the petitioner has been last paid only

Patna High Court CWJC No.2152 of 2015 dt.05-05-2015 2 / 2 till the year 1996. The Court does not want to express the reason as to why it is so, lest it may prejudice the case of the petitioner.

4. Let the Vice-Chancellor of the University on an application being filed by the petitioner with supporting materials take a decision on the claim of the petitioner within a period of four months from the date of filing of such application.
