The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a), 38 and 47 of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 150 litres beer and 237 litres of foreign liquor were recovered from the Innova vehicle which was being boarded by two persons including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 03.07.2017.
Considering the facts and the circumstances of the
Patna High Court Cr.Misc. No.39228 of 2017(2) dt.19-08-2017 2/2 case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Gaya in connection with Barachatti P.S. Case No. 389 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
