JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-04-2019 Mr. Kaushalesh Choudhary, learned counsel for the petitioner submits that the case of the petitioner is similar to the case of Bipin Bihari Roy versus The State of Bihar & Ors (C.W.J.C. No. 11936 of 2011) which was decide on 01.03.2017.

The petitioner has approached this Court for grant of ACP and MACP which has been paid to others who are even juniors to the petitioner and it is being unlawfully denied to him.

Patna High Court CWJC No.5633 of 2019(2) dt.11-04-2019 2/2 If the facts of the case of the petitioner is similar to the facts of Bipin Bihari Roy versus The State of Bihar & Ors (C.W.J.C. No. 11936 of 2011), the petitioner also should be given the same benefit.

For the aforesaid purpose, this Court directs the petitioner to file a representation before the Collector, Sitamarhi (respondent No. 6) within a period of four weeks from today, who shall verify the facts and pass necessary orders after finding that the case of the petitioner is similar to that of Bipin Bihari Roy versus The State of Bihar & Ors (C.W.J.C. No. 11936 of 2011).

If the claim of the petitioner is found to be tenable, necessary sequel order shall be passed within a period of six weeks thereafter.

With the aforesaid observation/direction, the writ petition stands disposed off.
