The petitioner apprehends his arrest in connection with Patepur P.S. Case No.346 of 2022 registered under Sections 30(a)/32(ii)/41(i) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. The petitioner is neither the owner of the seized vehicle nor seized liquor belongs to the petitioner. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

Patna High Court CR. MISC. No.15401 of 2023(2) dt.09-05-2023 2/2 parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Excise Court 2ndcum-Additional District and Sessions Judge, Vaishali at Hajipur/Concerned Court in connection with Patepur P.S. Case No.346 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
