JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-08-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Spl. Case No. 10221 of 2019 arising out of (Fatuha) Nadi P.S. Case No. 284 of 2019, registered under Section 30 of the Bihar Excise Act.
The accusation is that informant and other police personnel received information on 17.11.2019 about keeping the illicit liquor by Dasai Rai and his wife, Chandwati Devi in their house in village Jethuli, which was supplied by Munna Rai, Chintu Rai and Akhilesh Kumar (petitioner). Thereafter, house of Dasai Rai was search, from where, 12 cartoons each containing 24 bottles of 375 ml and one cartoon containing 12

Learned counsel for the petitioner submits that the bottles of seized illicit liquor are said to be recovered from the house of Dasai Rai but the petitioner has falsely been implicated in the present case due to dirty village politics. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Spl. Case No. 10221 of 2019 arising out of (Fatuha) Nadi P.S. Case No. 284 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
