JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioners being uncle, mother and aunt of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The accusation is of killing the daughter of the informant after about 21/2 years of the marriage for non-fulfilment of the dowry demand.
It is submitted by learned counsel for the petitioners that the victim was suffering from serious ailment for which she was given medical assistance also. The accusation against the petitioners is omnibus and general and the husband of the victim is
Patna High Court Cr.Misc. No.23123 of 2015 (2) dt.13-07-2015 2/2 in custody.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari in connection with Piprakothi P.S. Case No. 73 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
