This is an application for bail in connection with Muffasil P.S.Case No. 225 of 2017 registered for the offences punishable under Sections 341, 342, 323, 324, 307, 379, 427, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioners is of intercepting a truck and snatching cash and also of assaulting driver and others. Submission of learned counsel for the petitioners is that no specific allegation is attributed against the petitioners and charge has also not been submitted under Section 307 IPC and they are in custody for five months having no criminal antecedent. Heard learned APP also.

No.43788 of 2017 (3) dt.10-10-2017 2/2 Having heard both sides and in the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, in connection with Muffasil P.S.Case No. 225 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioners shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, their bail bonds shall be liable to be cancelled.
