The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No. 173 of 2017 for the offences punishable under Section(s) 30 (a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding the recovery of 337 liters of illicit liquor from the possession of the petitioner. The learned counsel for the petitioner submits that in fact no recovery has been made from the conscious possession of the petitioner and the said vehicle from where recovery has been made does not belongs to the petitioner. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 14.03.2018.
Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.30602 of 2018 (2) dt.22-05-2018 2/2 the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge (Excise) Vaishali, Hajipur in connection with Bhagwanpur P.S.
