The petitioner is apprehending his arrest in connection with Rajauli P.S.Case no.175 of 2018 registered for offences punishable under Section 414 of the Indian Penal Code. Allegation as per FIR is that a motorcycle was intercepted and the petitioner was arrested but he could not produce the papers of the motorcycle and the petitioner succeeded in fleeing away.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case, which will appear from the fact that though the police prepared a seizure list but on the seizure list there is no signature of the petitioner and the whole prosecution case is false and concocted as well as he has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record and if possible to be disposed of on the same day.

With the aforesaid direction, this application is disposed of.
