====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-05-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. In this case, the petitioner is seeking regular bail in connection with Malahi P.S. Case No. 06 of 2025, registered for the offences punishable under Sections 96, 137(2),3(5) of the BNS and Section 8, 12 of the POCSO Act.

3. As per allegation, the petitioner along with coaccused Nehal Ahmad kidnapped the minor daughter of the informant, with an intention to marry her.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.16496 of 2025(3) dt.13-05-2025 2/2 that the petitioner is innocent and has falsely been implicated in this case. The victim, in her statement recorded under Section 183 of the BNSS, did not make any allegation against the petitioner and when the real fact came to the knowledge of the informant, he compromised the case with the petitioner.

5. On the other hand, the learned counsel for the informant fairly conceded that both the parties have compromised the case.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 6th Additional Judge-cum-EX, Special Judge, POCSO Act, East Champaran, Motihari in connection with Malahi P.S. Case No. 06 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
