The petitioner seeks regular bail in connection with Ara Nawada P.S. Case No.478 of 2017 registered for the offences punishable under Sections 406, 420 and 468 of the Indian Penal Code.

It is alleged that this petitioner introduced himself as Field Manager of Suvidha Bank and on his assurance to give loan, the informant created nine groups and collected money from them to the tune of Rs.12 lacs. The informant handed over the said amount to the petitioner. Thereafter the petitioner fled away and switched off his mobile. The petitioner was caught by the informant and other members in Punjab National Bank where the

It has been submitted that the petitioner is in custody since 02.11.2017 for his no fault. The allegation of cheating and collecting money by the petitioner from the informant is vague. There is not a single chit of paper to show that any amount either from informant or from any person has been received by the petitioner and so the petitioner deserves bail. The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No.478 of 2017.
