2. The petitioner is apprehending his arrest in connection with Chakmehashi P.S. Case No. 117 of 2024, F.I.R. dated 22.07.2024 for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 308(3), 352 and 3(5) of the Bharatiya Nyay Sanhita, 2023.

3. According to prosecution case, the informant alleged that when he was returning home after day work then the petitioner along with other accused person arrived and assaulted him on his head by means of grass due to which bleeding started and he fell down.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been

Patna High Court CR. MISC. No.18095 of 2025(3) dt.28-07-2025 2/2 implicated in the present case. Due to some petty dispute the present occurrence has taken place and there is case and counter case between the parties and both sides received injury.

5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that from bare perusal of the FIR it appears that son of the petitioner caught hold the informant and the petitioner assaulted the informant and informant received injury and injury report suggest that injury is grievous in nature and the same is on vital part of the body.

6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Chakmehashi P.S. Case No. 117 of 2024 pending in the court of J.M. 1st Class, Samastipur.

7. Prayer is refused.
