The petitioner seeks regular bail in connection with Baheri P.S. Case No.49 of 2018 registered for the offences punishable under Sections 8, 20(1-b) (ii) (c), 25, 29 of NDPS Act and section 25(1-b) a/35 of the Arms Act.

On secret information the police party conducted raid in the house of petitioner and seized 2 kg ganja and one country made pistol from his possession. On interrogation, he did not produce any relevant paper with respect to the seized articles. He further confessed that a huge quantity of ganja has been kept in the house of one Raj Kumar and the key of that house is with him. After unlocking the room, the police seized 2 quintals of

Patna High Court Cr.Misc. No.29404 of 2018 (3) dt.02-07-2018 ganja from the room of Raj Kumar. The seizure list was prepared in presence of local witnesses and it bears the signature of this petitioner.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case as well as recovery of ganja and firearm from possession of this petitioner, I am not inclined to enlarge the petitioner on bail. The prayer of bail is accordingly rejected.
