1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Barh Police Station Case No. 455 of 2019, dated 30.09.2019, disclosing offences under Sections 379 of the Indian Penal Code.

3. That the prosecution case, as per First Information Report, is that on 29.09.2019 at about 01:00 A.M., two vehicles, bearing registration nos. BR01PJ8423 (white Scorpio S3) and BR01PA0155 (silver Bolero), were stolen from the compound of the informant. The said

Patna High Court CR. MISC. No.15046 of 2026(3) dt.01-05-2026 2/3 vehicles were owned respectively by Dilip Kumar Singh (informant) and Babita Devi (wife of Shashi Bhushan Kumar).

Learned counsel for the petitioner submits that the petitioner has not been named in the First Information Report and his name has transpired during course of investigation on the basis of confessional statement of Ravi Kumar, who has stated that the petitioner and other accused persons used to do rekee for the purpose of committing theft of vehicles, after which, they used to prepare forged paper in order to sell it in the market. He next submits that the petitioner is having criminal antecedent also, however, according to learned counsel, the cases registered against him are not of same offences.

Having regard to the submissions made on behalf of the parties and taking into consideration the nature of offence and the fact that an organized syndicate has been formed for the purpose of theft and sale of vehicles and statement of co-accused may be the basis of further investigation by the petitioner, for which, custodial interrogation of the petitioner may be necessary, I am not inclined to grant the petitioner privilege of anticipatory bail.
