Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 12.4.2017 passed in Cr. Misc. No.17741 of 2017, with direction to the learned trial court to expedite the trial of the petitioner and try to conclude the same within a period of seven months.

Submission of the learned counsel for the petitioner is that the trial has not been concluded and seven months' period has already expired. It is further submitted that the progress of the trial is very slow and there is no likelihood of conclusion of the trial in near future.

Heard learned A.P.P. also.

Having heard both sides and from perusal of the

Patna High Court Cr.Misc. No.47529 of 2017 (4) dt.20-12-2017 2/2 record submitted by the learned trial court, it appears that in this case, witnesses were produced for examination but at the instance of the defence, time was taken for cross examination and this is not one time but twice the time has been taken for cross examination.

In such view of the matter, considering the conduct of the petitioner, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and conduct it on regular basis so that the trial may be concluded within a reasonable time.

At the same time, the petitioner and other co accused persons are directed to co-operate in conclusion of the trial. With the aforesaid observation, this application is dismissed.
