Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel for the opposite party no.2 The petitioner apprehends his arrest in connection with Complaint Case No. 422 of 2018 for offences under Section 498A of the Indian Penal Code.
Learned counsel for the opposite party no.2 submits that the parties have settled their disputes.
Patna High Court CR. MISC. No.26021 of 2021(3) dt.01-04-2022 2/2 Considering the aforesaid fact, this application for anticipatory bail is allowed.
Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate,1st, Kaimur at Bhabua in connection with Complaint Case No.422 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
While accepting the bail bond of the petitioner, the court below shall verify from the opposite party no. 2 as to whether the dispute between the parties has been settled and if it is found that the dispute has already been settled, bail bond of the petitioner shall be accepted by the court below. If opposite party no. 2 denies the factum of settlement of dispute, the petitioner shall be taken into custody by the court below. (Sandeep Kumar, J) BT/- U T
