The petitioner prays for bail in Fatuha P.S. Case No. 298 of 2017 registered under sections 414 and 420 IPC. The informant whose motorcycle was stolen found the petitioner driving the said motorcycle and accordingly FIR was lodged Learned counsel for the petitioner submits that, in fact, the petitioner was standing by the side of the motorcycle. He is in custody since 27.07.2017.

I find from the impugned order that the learned Addl. Sessions Judge has granted liberty to the petitioner to renew his prayer for bail after framing of charge.

Prayer for bail is rejected. Let the petitioner invoke the

Patna High Court Cr.Misc. No.48080 of 2017(2) dt.16-10-2017 2/2 liberty granted by the learned Addl. Sessions Judge under the impugned order.
