JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The petitioner seeks regular bail in connection with Arer P.S. Case No. 91 of 2017, registered for offences punishable under Sections 290, 272 and 273 of the Indian Penal Code and Section 30(a) and 37(c) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 32 litres of liquor from the possession of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and he has been in judicial custody since 09.07.2017 and though he is an accused in one more case but he is on bail in that case.

Having heard both sides, considering the facts and circumstances of the case and as the petitioner has criminal

No.37835 of 2017 (4) dt.24-08-2017 antecedent as he is accused in one other case which is of similar nature as the present one, as such, this application is disposed of with direction to the court below to expedite the trial and try to conclude it within a period of four months and if the trial is not concluded within the aforesaid period, he will release the petitioner on bail to his own satisfaction.
