The petitioner seeks pre-arrest bail in connection with Aurai P.S. Case No. 307 of 2019, pending in the Court of the Special Judge, Excise Act, Muzaffarpur, registered under Sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

On receiving secret information about keeping the liquor by Awadhesh Rai (petitioner) in village Rajkhand, the informant, along with other police personnel, reached there. On seeing the police party, one person succeeded to flee away from the house. On search of the house, 16 bottles, each of 180 Indian made foreign liquor recovered beneath the stair of the house of the petitioner.

Patna High Court CR. MISC. No.14069 of 2020(2) dt.12-06-2020 2/2 Submission is that the petitioner has no criminal antecedent and he has not been apprehended from the house. Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail is rejected. The petitioner is directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
