ANJANA MISHRA ORAL ORDER 17-05-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.02.2018 in connection with Gardanibagh P.S. Case No.45 of 2018 registered for the offence under Sections 417 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that only because of the fact that the biometric of the petitioner has not matched with the thumb impression, which was taken from him at the time of physical test, the petitioner has been taken into custody. Learned counsel for the petitioner further submits that several other similarly situated persons, who had been taken into custody for the said reason and are accused in connection

Patna High Court Cr.Misc. No.29981 of 2018 (2) dt.17-05-2018 2/2 with the said case have since been released on bail by this Court in Cr.Misc. No.20733 of 2018 and its analogous cases, vide order dated 07.05.2018.

In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Sangeeta Rani, learned Additional Chief Judicial Magistrate-Cum-Sub-Judge-XIV, Patna, in connection with Gardanibagh P.S. Case No.45 of 2018.
