This application is for grant of regular bail in connection with Special Case NO.231 of 2017 arising out of Sour Bazar P.S.Case no.292 of 2017 , registered for the offences punishable under Sections 30A of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners is of recovery of 437 trs. of liquor in front of the house from two vehicles. Submission of the learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioners and they have fair antecedent. They are in custody since 21.6.2017.

Patna High Court Cr.Misc. No.42410 of 2017 (2) dt.13-09-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of recovery of huge quantity of liquor, this application is disposed of with direction to the learned court below that once the charge is framed or the petitioners completes judicial custody for six months, whichever is ever, the learned court below will release the petitioners on provisional bail in connection with Special Case NO.231 of 2017 arising out of Sour Bazar P.S.Case no.292 of 2017 to his own satisfaction.
