The petitioner seeks bail in Bairiya P.S. Case No. 72/2018 registered under Sections 341, 323, 307, 354, 379 and 504/34 of the Indian Penal Code.

As per the prosecution case, the petitioner is said to have assaulted on the head of the informant by means of Farsa on interrogation of Chandan Kumar by him for trying to outrage the modesty of his girl.

It is submitted by learned counsel for the petitioner that there is case and counter case between the parties. There is only one head injury to the informant which is simple in nature. There is no repetition of blow. The petitioner has no criminal

Patna High Court Cr.Misc. No.31270 of 2018 (2) dt.21-05-2018 2/2 antecedent. The petitioner has been languishing in custody since 01.04.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned IVth Additional Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 72/2018.
