This is an application seeking quashing of the FIR of Sohsarai P.S. Case No. 26 of 2016 dated 20.02.2016 instituted for the offence under Sections 348, 323 and 353 of the IPC and Section 135 of the Electricity Act.

Learned counsel for the petitioner has passed on the information that after submission of charge sheet, the case has gone in trial. However, no witness is appearing before the trial court.

In that view of the matter, I am not inclined to

Patna High Court CR. MISC. No.22643 of 2016(3) dt.14-10-2020 2/2 accede to the prayer made by the petitioner for quashing of the subject FIR.

The petition is dismissed.

However, the trial court is directed to expedite the trial and conclude it positively within a period of nine months from the date of production/receipt of a copy of this order.
