This application has been filed by the petitioner for modification in the order dated 16.05.2017 passed in Criminal Misc. No. 22695 of 2016 by this court with regard to extend the period for compliance of order dated 16.05.2017. Learned counsel for the petitioner submits that vide order dated 16.05.2017 passed in Criminal Misc. No. 22695 of 2016, the petitioner was granted provisional pre-arrest bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sri

Patna High Court Cr.Misc. No.46360 of 2017 (2) dt.04-10-2017 Mahavir Prasad, Judicial Magistrate Ist Class, Aurangabad, in connection with Risiap P.S. Case No. 17 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C., subject to the payment of 20% of the remaining amount of Rs.74,84,645/- to the Bihar State Food Corporation, Aurangabad, within four months, but the petitioner only deposited Rs.5,00,000/-, out of Rs.14,96,929/- and remaining amount could not be deposited due to serious illness of wife of the petitioner and now he is ready to pay remaining amount within two months. In that view of the matter, learned counsel for the petitioner prays for extension of period for depositing the remaining amount.

Considering the submission of the learned counsel for the petitioner, two months further time is allowed to comply of the order dated 16.05.2017 passed in Criminal Misc.
