The petitioner apprehends his arrest in Excise P.S. Case No. 52 of 2021, registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2018.
72 litres of foreign liquor has been recovered from Indica car and 918 litres of foreign liquor has been recovered from a room constructed of asbestos.
It is submitted that nothing has been recovered from conscious possession of this petitioner. The room in question does not belong to this petitioner.
Counsel for the State vehemently opposed the bail
Patna High Court CR. MISC. No.15444 of 2022(4) dt.12-08-2022 2/2 application and submitted that petitioner has got four criminal antecedents of similar nature.
Considering the criminal antecedent of petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail.
Accordingly, the prayer for anticipatory bail is rejected.
