The petitioner, already in custody, seeks bail in connection with Naubatpur P.S.Case No. 433 of 2017 registered under Sections 25(1-b)a/26 of the Arms Act.

Submission is that alleged recovery is not from the conscious possession of the petitioner rather it was from his new house which is undergoing construction and is accessible to anyone, moreover, petitioner has no criminal antecedent and is in custody since 17.12.2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Pappu Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Danapur, Patna in connection with Naubatpur P.S. Case No. 433 of 2017.
