2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 504, 506, 353 and 332/34 of the Indian Penal Code.
3. Petitioners along with other accused persons are said to have caused hurt to the informant party and obstructed them from discharge of duty.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He submits that there is no specific overt act against the petitioners. He submits that for the same occurrence, the
Patna High Court CR. MISC. No.20621 of 2024(3) dt.08-05-2024 2/2 informant has lodged two cases as Banka P.S. Case No. 754 of 2022 and the instant case. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the nature of offence, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Banka P.S. Case No. 755 of 2022.
7. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order. Learned counsel below is also directed to consider the Apex Court judgment in the case of Satendra Kumar Antil Vs. Central Bureau of Investigation & Anr. reported in (2022) 10 SCC 51 and in the case Arnesh Kumar Vs. State of Bihar reported in (2014) 8 SCC 273.
